Terms of Service
1. Acceptance
By installing, accessing, or using any Starch Development product you agree to these Terms. How we handle your data is covered separately in our Privacy Policy, and for Potato Quest specifically in the Potato Quest Privacy Policy.
2. Eligibility
Our products are general-audience games. If you are under the age of majority where you live, you may use them only with the involvement of a parent or guardian who agrees to these Terms on your behalf. Some features — including friends, challenges, and notifications — require signing in with an Apple or Google account, which may have its own age requirements.
3. Accounts
You can play as a guest, or sign in with Apple or Google to keep your progress across devices. You are responsible for activity on your account. Keep your sign-in credentials safe. If you suspect unauthorised use, contact us.
You can delete your account and personal data at any time — from inside the app, or through our account and data deletion page.
4. Acceptable use
You agree not to:
- Cheat, exploit, reverse engineer, or use unauthorised automation.
- Choose a username that is harassing, hateful, obscene, or impersonates another person.
- Disrupt the service or attempt to access other users' data.
We may suspend or remove accounts that breach these rules.
5. Intellectual property
All game content — code, art, audio, designs, branding — is owned by Starch Development or its licensors. You receive a personal, non-transferable licence to use it through our apps.
6. Your username and public gameplay
If you choose a username, it is shown to other players on leaderboards, challenge screens, and friends lists. Gameplay you record — including scores and replay data used to generate "ghost" opponents — may be replayed by other players in competitive modes. You grant us the right to store, reproduce, and display this content for the purpose of operating those features. Do not choose a username containing personal information you do not want shown publicly.
7. In-app purchases
Some products offer optional purchases (e.g. the Potato Quest Unlimited Pass, a one-off purchase that removes ads and daily attempt limits). Purchases are handled by the App Store or Google Play, are tied to that store account, and are subject to the respective store's refund policy. We do not receive or store your payment card details.
8. Virtual items and in-game currency
Coins, crowns, cosmetic items, levels, and similar in-game rewards are a licence to use features within the game. They have no monetary value, cannot be exchanged for money or transferred between accounts, and cannot be bought with money. We may adjust in-game balancing, prices, and reward rates as the game develops. If your account is deleted or terminated, any virtual items associated with it are lost.
9. Advertising
Our games may be funded in part by advertising, including ads you can optionally watch in exchange for extra attempts. Where legally required, we ask for your consent before serving personalised ads, and you can change that choice through the in-app or platform consent controls.
10. Service availability and changes
Our games rely on internet-connected services for features such as leaderboards, matchmaking, friends, and challenges. We may modify, suspend, or discontinue any part of a product or its online features, including after a reasonable period of notice where practical. Offline single-player play does not depend on these services.
11. Suspension and termination
We may suspend or terminate access to accounts that breach these Terms, or where required by law. You may stop using our products at any time and delete your account as described in section 3.
12. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot be excluded, restricted, or modified by agreement. Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law.
Where we are permitted to limit rather than exclude our liability, our liability is limited to, at our option, resupplying the relevant service or paying the cost of having it resupplied.
13. Disclaimers
Subject to section 12, and to the maximum extent permitted by law, the service is provided "as is" and "as available" and we disclaim all other warranties.
14. Limitation of liability
Subject to section 12, and to the maximum extent permitted by law, our total liability for any claim relating to the service is capped at the amount you paid us in the 12 months before the claim, or AUD $50 — whichever is greater.
15. Changes to these Terms
We may update these Terms as our products change. When we do, we will update the "last updated" date above and publish the current version at starchdevelopment.com/legal/terms. If a change materially reduces your rights, we will take reasonable steps to bring it to your attention. Continuing to use our products after a change takes effect means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
